The Supreme Court just released a decision in the case of Fulton v. City of Philadelphia. The question is whether a municipality can limit participation in a government program using neutral and generally applicable laws that happen to infringe on religion. The answer was an unsatisfying: The law before us is not neutral and generally applicable because it allows the Commissioner of the Department of Health and Human Services to grant exceptions.
